Buying vapes in the USA: laws, prices and where to buy.

Straight answers to the questions people search most about vaping in the United States. Each section starts with the short answer, then the details.

Is vape available in the USA? Can I buy vapes in America?

Yes. Adults 21 and older can buy vapes in most of the country at vape shops, smoke shops, convenience stores, gas stations and age-verified online stores. Which products you can buy depends on your state.

Yes. Vapes are sold across the U.S. to adults 21 and older. What you can buy depends on where you live:

  • In most states you can buy flavored disposables such as the Geek Bar Pulse X or RAZ LTX 25K.
  • In California, Massachusetts, New Jersey, New York, Rhode Island and Utah, flavored vapes are restricted, so stores mainly sell tobacco and (in some of those states) menthol products.
  • In directory states, stores can only sell listed products, which in practice means mostly FDA-authorized brands.

Visitors from abroad need to be 21 too. Bring ID; U.S. stores check it.

Where can I buy vapes in the USA?

At licensed vape and smoke shops, convenience stores and gas stations, and online stores that verify your age at checkout and require an adult signature on delivery, as the federal PACT Act requires.

  • Vape shops and smoke shops have the widest choice of devices and flavors.
  • Convenience stores and gas stations carry the best-known brands. Breeze Pro is especially common at c-stores in the Midwest and Northeast.
  • Online stores are legal if they follow the federal PACT Act: they must verify your age, ship with a carrier that checks ID and collects an adult signature, and never use the U.S. Postal Service.

How to spot a trustworthy online store: it asks your date of birth before checkout, says how deliveries are age-verified, explains its shipping policy, and shows a real business address and phone number. Be wary of ELFBAR-branded disposables sold in the U.S.; the brand sells here as EBCREATE, so ELFBAR packaging is often counterfeit.

What changes the price: state and local taxes, special editions (for example Geek Bar’s Platinum and Slush editions), 5-pack discounts, and whether a model is in short supply. The Breeze Pro, a simple 2,000-puff device, usually sells for $11 to $20.

Are any vapes FDA approved in the USA?

The FDA doesn't approve vapes; it authorizes them. As of August 2026 it has authorized 48 e-cigarette products from Glas, JUUL, Logic, NJOY and Vuse, almost all tobacco or menthol flavored. Authorization doesn't mean a product is safe.

“FDA approved” is a common phrase, but the FDA uses the word authorized. It means a company showed that selling the product is “appropriate for the protection of public health.” It does not mean the product is safe. As of August 2026, 48 e-cigarette products have authorization:

CompanyAuthorized devicesAuthorized flavors
R.J. Reynolds (Vuse)Vuse Alto, Vuse Solo, Vuse Vibe, Vuse CiroTobacco / Original
NJOYNJOY Ace, NJOY DailyTobacco, menthol
JUUL LabsJUUL, JUUL2 (added August 2026)Virginia Tobacco, menthol
LogicLogic Power, Logic Pro, Logic VapeleafTobacco
GlasGlas G2Tobacco, menthol

None of the popular flavored disposables, including Geek Bar, EBCREATE, Lost Mary, RAZ and Breeze Smoke, has FDA authorization. That includes every product we sell.

Where can I buy FDA approved vapes?

FDA-authorized vapes such as Vuse Alto, NJOY Ace, JUUL and Logic are sold mainly at convenience stores, gas stations and tobacco shops. Check the FDA's authorized list at fda.gov/authorizedecigs before you buy.

Authorized products are carried by most convenience stores and gas stations, and by many tobacco shops. Because they are mostly tobacco and menthol flavors, they are also what you’ll find in states with flavor bans.

To check whether a product is authorized, look it up on the FDA’s list of authorized e-cigarettes at fda.gov/authorizedecigs. Dang Vape doesn’t currently stock authorized products.
